Texas Attorney General Ken Paxton has taken legal action against 3M and DuPont, alleging the companies falsely marketed PFAS-containing products as safe despite knowing the chemicals’ dangers.
PFAS chemicals are known for their persistence in the environment and their link to health issues like cancer and thyroid disease. These “forever chemicals” are commonly found in products such as Teflon, Stainmaster, and Scotchgard.
The lawsuit claims that for more than 50 years, 3M and DuPont were aware of the harmful effects of PFAS but concealed these risks while continuing to sell their products. “Defendants marketed products containing harmful PFAS chemicals for over 70 years, misleading consumers and concealing risks of harm,” the filing states.
“These companies knowingly put families and children at risk by advertising toxic products as safe for household use,” Paxton said. “Texas is taking a stand to hold them accountable for their actions.”
This lawsuit builds on previous actions Paxton has taken against PFAS manufacturers, including litigation over firefighting foam that caused environmental damage. The case highlights the widespread impact of PFAS contamination in Texas and beyond.
With the Lanier Law Firm and Kelley Drye & Warren LLP serving as outside counsel, the lawsuit seeks to impose penalties on 3M and DuPont for their role in perpetuating the use of dangerous chemicals.
