Lawmakers emphasized that Smith’s team is not exempt from congressional oversight.

The letter pointed to media reports suggesting Smith’s office had prepared for Trump’s win. “Prosecutors in your office have been ‘gaming out legal options’ in the event that President Trump won the election,” the letter stated. It further warned against altering or deleting records and called for full transparency.

Republicans are particularly critical of Smith’s handling of cases involving Trump, accusing him of partisanship. Smith has been at the center of two high-profile cases against Trump, including charges related to the 2020 election and the retention of classified documents.

Recent reports indicate Smith’s team is hesitant to close investigations despite Trump’s reelection. CNN revealed that Smith’s office plans to continue pursuing legal options for as long as possible. A source told the outlet, “He’s not going to be the one to say, ‘I’m going to fold the tent.’”

In a letter to Judge Tanya Chutkan, he asked to vacate upcoming deadlines, citing an “unprecedented circumstance.” Republicans see these developments as further proof that Smith’s investigations are politically motivated, and they are determined to hold him accountable.
