Republican Lawmakers Demand Investigation

Two Republican congressmen are calling on FBI Director Kash Patel to investigate what they describe as a cover-up by the Biden administration regarding the deaths of five aborted infants. Representatives Chip Roy of Texas and Andy Biggs of Arizona, who chair relevant congressional subcommittees, have sent a formal request demanding examination of the so-called “D.C. Five” case that has remained largely uninvestigated since 2022. The lawmakers expressed grave concerns about potential violations of federal laws, including the Partial-Birth Abortion Ban Act of 2003 and the Born-Alive Infants Protection Act of 2002, which prohibit certain late-term abortion procedures and require medical care for infants born alive during abortion attempts.

“Serious questions remain surrounding the deaths of these children,” stated Representatives Chip Roy and Andy Biggs in their letter to Director Patel. “Very strong evidence suggests the ‘DC Five’ unborn children were killed within miles of our US Capitol building.”

Discovery of the D.C. Five

The case first came to light in March 2022 when pro-life activists discovered the remains of five apparently late-term aborted infants outside Washington Surgi-Clinic in Washington, D.C. This discovery occurred shortly before the Supreme Court overturned Roe v. Wade. The activists reported their findings to authorities, claiming the physical evidence suggested the infants may have been victims of illegal partial-birth abortions or possibly even born alive before dying. According to the lawmakers’ letter, the Biden administration and local D.C. officials, including Mayor Muriel Bowser, failed to properly investigate these allegations despite the potentially serious legal implications.

“Under the Biden Administration and the tenure of former Director Christopher Wray, the Federal Bureau of Investigation (FBI) departed from its core public safety mission, suffered from senior leadership failures, and refused any real transparency or accountability for its actions.” Roy wrote.

Allegations Against D.C. Abortionist

The congressional request specifically references allegations against Dr. Cesare Santangelo, the abortionist at Washington Surgi-Clinic. Pro-life activists have claimed that Santangelo has committed illegal acts, including allowing babies born alive during abortion procedures to die without medical intervention. The lawmakers emphasized that the condition of the recovered remains warrants professional forensic examination to determine whether federal crimes were committed. They pointed to visible physical evidence suggesting the infants may have been subjected to partial-birth abortion procedures, which have been illegal under federal law since 2003.

“As Chairs of the Subcommittee on the Constitution and Limited Government and the Subcommittee on Crime and Federal Government Surveillance, we remain concerned about the Biden-Harris Administration’s refusal to investigate the circumstances of the case of five aborted children, also known as the D.C. Five, whose remains were allegedly discovered at the Washington Surgi-Clinic in March 2022 by a pro-life advocacy group.” Roy wrote.

Claims of Selective Enforcement

Roy and Biggs also criticized what they characterized as selective enforcement of federal laws by the Biden administration. They claimed that while the Department of Justice aggressively prosecuted pro-life activists under the Freedom of Access to Clinic Entrances (FACE) Act, it simultaneously ignored potential violations of federal abortion laws. The congressmen noted that Representative Roy had previously requested the Biden Department of Justice to preserve evidence related to the D.C. Five but received no response. This apparent lack of action, they argued, represents a serious failure in the administration’s duty to enforce existing laws.

“I am confident the current leadership at the DOJ and FBI will take action to defend life in our nation’s capital and to ensure that these five babies receive justice.” Roy told The Daily Wire on Tuesday.

Next Steps in the Investigation

The lawmakers have requested that the FBI review all available evidence by April 29 and provide a briefing on their findings. They specifically asked for an independent medical examination of the remains to determine whether federal crimes were committed. Pro-life advocates hope this investigation will not only provide justice for the five deceased infants but also expose what they believe are illegal practices within the abortion industry. With Kash Patel now leading the FBI, the congressmen expressed optimism that their request would receive proper attention, unlike their previous attempts during the Biden administration.
